These Terms and Conditions govern your access to and use of Markat.ai.
By accessing or using the platform, you agree to be bound by these Terms.
If you do not agree, you must not access or use Markat.ai.
1. Platform Overview
Markat.ai is a platform designed to support the testing, evaluation, and structured feedback of AI products and tools.
Markat.ai is currently operating as a Private Beta Sandbox, meaning access is limited, features may change, and participation is subject to approval and ongoing compliance with these Terms.
Markat.ai does not act as a marketplace, reseller, broker, or certifying authority unless explicitly stated otherwise.
2. Eligibility
To use Markat.ai, you must:
- Be at least 18 years old
- Have the legal capacity to enter into binding agreements
- Provide accurate, current, and complete information during registration
Markat.ai reserves the right to refuse or revoke access at its sole discretion.
3. Accounts and Access
- All users must register and be approved.
- Approval is discretionary and may be revoked at any time.
- You are responsible for safeguarding your account credentials.
- You may not share, sell, or transfer your account.
Markat.ai may suspend or terminate accounts without notice if these Terms or the Rules of Engagement are violated.
4. User Roles
Markat.ai currently supports, but is not limited to, the following roles:
- Developers: Users submitting AI products or tools for testing.
- Testers: Users approved to evaluate and provide feedback on AI products.
Users may hold more than one role, subject to approval.
5. Intellectual Property
5.1 Developer Content
Developers retain ownership of their AI tools, products, and related intellectual property.
By submitting a tool to Markat.ai, developers grant Markat.ai a non-exclusive, royalty-free, worldwide license to:
- Display the tool within the platform
- Enable testing and feedback
- Analyze usage and feedback data for platform operations
5.2 Tester Content
Testers retain ownership of original feedback they submit.
By submitting feedback, testers grant Markat.ai a non-exclusive, royalty-free right to:
- Display, store, analyze, and use feedback for platform improvement and evaluation purposes
5.3 Platform IP
All platform design, structure, branding, systems, and internal logic are the exclusive property of Markat.ai.
6. No Warranties
Markat.ai is provided “as is” and “as available.”
Markat.ai makes no warranties or representations regarding:
- The performance, accuracy, or reliability of any AI tool
- The quality or usefulness of feedback
- Commercial success, compliance, or fitness for any purpose
- Continuous or uninterrupted access
Participation in the platform is at your own risk.
7. Limitation of Liability
To the maximum extent permitted by law:
- Markat.ai shall not be liable for indirect, incidental, special, or consequential damages
- Markat.ai is not responsible for losses arising from third-party tools, services, or external testing environments
- Markat.ai does not assume liability for decisions made based on platform feedback or ratings
8. Third-Party Services
Testing may occur on third-party websites, platforms, or systems controlled by developers.
Markat.ai does not control and is not responsible for:
- Third-party data handling
- Security practices
- Terms or policies of external services
9. Private Beta Sandbox Status
As a Private Beta Sandbox:
- Features, workflows, and access rules may change without notice
- Data, feedback, ratings, tokens, or visibility may be modified or reset
- No guarantees are made regarding continuity, preservation, or outcomes
10. Termination
Markat.ai may suspend or terminate access at any time, with or without notice.
Users may discontinue use of the platform at any time.
Termination does not affect rights or obligations that accrued prior to termination.
11. Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
Any disputes shall be resolved exclusively in the competent courts of that jurisdiction.
12. Changes to These Terms
Markat.ai may update these Terms from time to time.
Continued use of the platform after changes are published constitutes acceptance of the updated Terms.
